What is a Victim Impact Statement?

Missouri crime victims will often receive a document from the prosecuting attorney that is called a “Victim Impact Statement.”  This is a form to be filled out by the crime victim and returned to the prosecuting attorney. 

The purpose of this document is three-fold.  First, it allows victims to tell the prosecutor how involved they want to be in the criminal case.  The forms generally have a section where the victim can indicate whether or not they want to attend court hearings. 

Secondly, the form is an opportunity for the victim to express to the prosecutor how the crime has impacted his/her life.  The victims can describe physical injuries, emotional strain, and list any direct financial expenses.

Finally, the form usually has a section where the victim can offer suggestions as to what they feel the punishment should be for the criminal defendant.  Victims must keep in mind that although they can suggest a punishment, these suggestions are not binding on the prosecutor or the court.

It is a good idea for victims to fill out and return victim impact statements.  By doing so, they demonstrate that they care about the criminal case, and are likely to have a greater voice in the final outcome.  In filling the form out, victims will want to make sure that they are both thorough and truthful.
